When you purchase a used vehicle, most dealers will have you sign an “As Is” form.
As Is is a legal term used to disqualify any implied warranties for a vehicle being sold. “As Is” indicates that a seller is selling and a buyer is buying a vehicle in whatever condition that it is in, and that the buyer is accepting the vehicle with all that is wrong with it, whether it is immediately apparent or not.
However the phrase “as is” does not disclaim any expressed warranties, such as those created by the seller’s description of a vehicle. The vehicle may be sold as is, but if it is not what the seller says it is then the buyer has a right to reject said vehicle.
Once you drive off of the lot (take delivery) and the engine seizes or the transmission falls out. Unless you the buyer can prove that fraud is involved, you are not entitled to a refund.
There are a couple of ways to protect yourself:
a. Purchase a service contract. A service contract will provide you the protection you need. Once you take delivery the dealer is not responsible for anything that goes wrong with that vehicle. You should always negotiate a service contract when purchasing a used vehicle.
b. Another way to protect yourself is to have the vehicle checked out by your mechanic. Most dealers will allow this if you are serious about purchasing their vehicle. But keep in mind that it is a used vehicle and will probably have some minor issues. Too many people expect a new car for used car money.
If you want a vehicle in new condition then buy a new vehicle.
